Why simply monitoring for hallucinations is insufficient Legal AI governance has focused almost entirely on the problems associated with hallucination: courts have sanctioned lawyers for fabricated citations, and bar associations across multiple jurisdictions have issued guidance in response. But hallucination is only the most visible failure mode, producing output that can be checked for accuracy. In contrast, the four failure modes that generate the majority of material legal workflow risk produce no obvious error signal. It also establishes a six-level governance maturity model for assessing an organization’s current program and defining what implementing the next level of controls requires in practice.
